Welcome to Provenant.net (the “Site”), owned and operated by Provenant (“Provenant,” “we,” “us,” or “our”), a Delaware corporation with its principal office at 8 The Green, Ste B, Dover, DE 19901, USA (LEI: 984500983AD71E4FBC41). By accessing or using the Site, you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the Site.
1. Acceptance of Terms
By accessing Provenant.net, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We reserve the right to modify these Terms at any time. Changes become effective upon posting to the Site. Your continued use of the Site following any modifications constitutes acceptance of the revised Terms.
2. Description of Services
Provenant provides informational content about our open verifiable communications platform, including the Verifiable Voice Protocol (VVP), branded calling solutions, the Origin platform, and related products and services. The Site also provides a contact mechanism for requesting demonstrations and additional information. The Site does not currently offer transactional services, user accounts, or e-commerce functionality.
3. Use of the Site
You agree to use the Site only for lawful purposes and in accordance with these Terms. You shall not: (a) use the Site in any way that violates applicable federal, state, local, or international law or regulation; (b) attempt to interfere with or disrupt the integrity or performance of the Site or its underlying systems; (c) attempt to gain unauthorized access to any portion of the Site; (d) use any robot, spider, scraper, or other automated means to access the Site without our prior written permission; or (e) introduce any viruses, Trojan horses, worms, or other harmful material.
4. Intellectual Property
All content on the Site, including but not limited to text, graphics, logos, images, software, and the compilation thereof, is the property of Provenant or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. The Provenant name, logo, Verifiable Voice Protocol (VVP), and Origin platform names are trademarks of Provenant. Technologies referenced on the Site, including KERI (Key Event Receipt Infrastructure) and ACDC (Authentic Chained Data Containers), may be subject to separate open-source licenses. You may not reproduce, distribute, modify, or create derivative works of any Site content without our prior written consent.
5. Third-Party References
The Site may reference third-party organizations, partnerships, or standards bodies, including but not limited to GSMA, GLEIF, Microsoft, AudioCodes, Orange, Tata, Wavecrest, and Finema. These references are for informational purposes only and do not imply endorsement by such third parties. Third-party trademarks belong to their respective owners.
6. Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PROVENANT DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. INFORMATION PROVIDED ON THE SITE REGARDING TELECOMMUNICATIONS TRUST STATISTICS, FRAUD LOSSES, AND MARKET DATA IS FOR INFORMATIONAL PURPOSES ONLY AND MAY NOT BE CURRENT.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PROVENANT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM (A) YOUR USE OF OR INABILITY TO USE THE SITE; (B) ANY CONTENT OBTAINED FROM THE SITE; OR (C) UNAUTHORIZED ACCESS TO YOUR TRANSMISSIONS OR DATA. OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).
8. Indemnification
You agree to indemnify, defend, and hold harmless Provenant and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site or violation of these Terms.
9. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in the State of Delaware, and you consent to the personal jurisdiction of such courts.
10. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
11. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Provenant regarding the use of the Site.
